These Terms of Service ("Terms") govern your access to and use of the website https://hairskinmedix.com (the "Site"), the mobile site, and all related services, including but not limited to, skin and hair consultations, aesthetic procedures, and the sale of medicinal products (collectively, the "Services") offered by AVAN DERMA PRIVATE LIMITED ("HairSkinMedix," "we," "us," or "our").

By accessing or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions of this agreement, you may not access the Site or use any Services.

2. Medical & Treatment Disclaimer

A. Professional Consultation

• All Services, aesthetic treatments, and medicinal products are provided or recommended by qualified, registered medical practitioners (Doctors/Physicians/Hair Coaches) affiliated with or employed by HairSkin Medix, in compliance with applicable Indian medical laws.
• The information provided on the Site is for general knowledge and educational purposes only. It is not a substitute for personalized professional medical advice, diagnosis, or treatment.
• The decision to undergo any treatment or consume any medicine is solely between you and the consulting medical practitioner. You must fully disclose your medical history, allergies, and current medications during consultation.

B. Suitability and Refusal of Treatment

• HairSkin Medix and its medical practitioners reserve the right to determine the suitability of any treatment, procedure, or medicine for you.
• We may refuse to provide or discontinue treatment at any time if the practitioner deems it medically or ethically inappropriate, or if you fail to adhere to pre- or post-treatment instructions.

C. Results and Risks

• You acknowledge that individual outcomes from treatments and medicines vary significantly based on personal factors (e.g., body chemistry, lifestyle, adherence to instructions).
• We make no guarantees regarding the outcome of any treatment or procedure.
• You confirm that you have been informed of and accept the inherent risks, side effects, and potential complications associated with aesthetic procedures and prescription medicines.

3. Purchase and Sale of Medicinal Products

A. Prescription Requirement

• The sale of any Medicine or Prescription-Only Drug through the Site or clinic is strictly subject to a valid, written, or electronic prescription issued by a qualified, registered medical practitioner associated with HairSkin Medix.
• You agree that any medicine dispensed is solely for your personal consumption as prescribed. You shall not transfer or sell the medicine to any other person.

B. Fulfillment and Dispatch

• HairSkin Medix may use licensed third-party pharmacies to fulfill and dispatch your prescription medicine orders. By placing an order, you consent to us sharing your prescription and relevant personal information (including SPDI) with these licensed pharmacies for the purpose of fulfillment.
• We adhere to all regulations regarding the storage, packaging, and shipping of medicines.

C. Returns and Refunds (Medicine)

• Due to the nature of pharmaceutical products and Indian regulatory requirements, Prescription Medicines are generally non-refundable and non-returnable once sold, unless the product is defective, expired, or an incorrect item was delivered.
• Any request for a refund or return will be subject to our separate Refund and Cancellation Policy, which is incorporated herein by reference.

4. Appointments, Cancellation, and Payments

A. Booking and Confirmation

• All appointments for consultation or treatment must be pre-booked and confirmed.
• To secure certain appointments or packages, a non-refundable deposit may be required.

B. Cancellation Policy

• We require a minimum of 24 hours' notice to cancel or reschedule a consultation or treatment.
• Failure to provide the required notice (a "Late Cancellation") or failure to attend an appointment ("No-Show") may result in:
  • Forfeiture of any prepaid deposit.
  • Forfeit of one pre-paid session from a treatment package.
  • A penalty fee being charged before future bookings are permitted.

C. Pricing and Payment

• Prices for Services, aesthetic treatments, and products are subject to change without prior notice.
• Payment is due in full at the time of service or product purchase, unless otherwise agreed (e.g., pre-paid packages).
• Any quoted price for a course of treatment or package is valid for 14 days only.

5. Course of Treatment / Packages

• All pre-paid courses or packages for treatments (e.g., laser sessions, peels) have a strict expiry period of 12 months from the date of purchase. Any unused sessions remaining after this expiry period will be automatically forfeited.
• Packages are non-transferable to another person or to a different treatment type unless a transfer is agreed upon at the sole discretion of the management for medical reasons.
• Refunds on unused sessions in a package will only be considered for documented medical reasons preventing the continuation of treatment, as reviewed by our medical panel. Any refund amount will be calculated by deducting the full list price of all treatments already taken (not the discounted package price) and any No-Show/Late Cancellation fees, with the remaining balance being refunded.

6. User Conduct and Intellectual Property

A. Personal Use

• You agree to use the Services and any Products (including prescribed medicines) only for your own personal use and not on behalf of any other person.

B. Prohibited Conduct

• You must not engage in any abusive, harassing, or disruptive behavior towards our staff, medical practitioners, or other clients. We reserve the right to immediately deny service and terminate access for any such conduct.

• Limitation of Liability: To the maximum extent permitted by law, HairSkin Medix shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Services, including but not limited to treatment dissatisfaction, personal injury, data loss, or system failure, except where such damages are explicitly proven to result from our gross negligence or willful misconduct.
• Indemnity: You agree to indemnify, defend, and hold harmless HairSkin Medix, its directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.

8. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any dispute or claim arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
